FDA Globalization Act of 2008: Fees, Fees, and More Fees Yesterday, the U.S. House of Representatives Committee on Energy and Commerce released a Discussion Draft of the "Food and Drug Administration Globalization Act of 2008."  The “Discussion Draft is meant to stimulate discussion about how to provide adequate funding and authority for FDA to ensure safety of . . . food, drug, medical device, and cosmetic” products, according to a memorandum accompanying the draft legislation.  The Energy and Commerce committee intends to hold hearings and to markup the draft in the next few weeks.  The Discussion Draft contains comprehensive language that addresses the safety of food, drugs, devices, and cosmetics as well as a number of general provisions relating to the agency.  Although the draft may undergo significant change during hearings and markup, there are several noteworthy provisions.  The draft proposes an annual registration fee of $2,000 for food facilities operating in the U.S. or exporting food to the U.S., would require labeling to identify the country-of-origin of foods and whether certain foods have been treated with carbon monoxide, and would provide FDA with mandatory recall authority.  With regard to drugs and devices, the draft proposes a registration fee to cover the cost of drug and device inspections, and would require country-of-origin labeling.  The draft also would require cosmetic facilities to register with the FDA at a cost of $2,000 per facility and require adverse-event reporting for cosmetics.  Finally, the draft proposes to increase the capacity of FDA to monitor foreign facilities.  [full story]

TERMS OF REFERENCE FOR THE COMMITTEE'S STUDYON NATURAL HEALTH PRODUCTS That the Standing Committee on Health consult, analyze and make recommendations regarding the legislative and regulatory regime governing traditional medicines (including, but not limited to, traditional herbal remedies, traditional Chinese, Ayurvedic and Native North American medicines), homeopathic preparations and vitamin and mineral supplements; That the Standing Committee consult broadly with stakeholders, including, but not limited to, associations and individuals representing consumers, manufacturers, distributors, growers, importers, exporters and retailers; That the Standing Committee consider the objectives of providing consumers freedom of choice and access to natural health products while ensuring the quality and safety of such products; That the Standing Committee consider the legislative and regulatory regimes governing natural health products in other countries. Food and Drugs Act         The House resumed consideration of the motion that Bill C-51, An Act to amend the Food and Drugs Act and to make consequential amendments to other Acts, be read the second time and referred to a committee.      [Table of Contents] Mr. James Lunney (Nanaimo—Alberni, CPC):       Mr. Speaker, it is fair to say that Bill C-51 has attracted a fair bit of attention. We have been debating it again today.     Bill C-51 is an act to amend the Food and Drugs Act and to make consequential amendments to other acts. Needless to say, the Food and Drugs Act definitely needs updating. It is an old act. It goes back to about 1934. It has had a few tweaks along the way, but certainly it is time for some updates to the Food and Drugs Act.     There are some good provisions in the bill, that is for sure, including life cycle monitoring of pharmaceutical drugs and mandatory reporting of adverse events. These are very positive things that need to be done because there are serious concerns about these products.     The public response overwhelmingly on the negative side has been over concerns about what will happen to the natural health products industry under the regulations.     In illustrating some of those concerns, I wish to make reference to a letter that I received recently from a number of very distinguished and concerned scientists, which illustrates the concerns that are out there. A Strategy to defeat all supporting MP’s and Tony Clement in the next Federal Election   Leo,   Great e-mail.   Definitely we need to do everything possible to defeat Tony.   We helped defeat Dingwall in 1997 and Allan Rock worked with us.   It took two tries but we helped defeated Anne McLellan.   I have a great approach to any politician we want to get, I will go to Parry Sound and area for the last two weeks of the federal election campaign [subject to funding] and run against Tony for the Republican Party of Canada [see www.republicanpartyofcanada.ca].   I run in my local Provincial and federal elections for a number of times just to get our issues out in the open where even the mainstream media is forced to deal with our “Different Viewpoints” and it has worked really well.   Can you image at the all candidate meetings with me and Tony eye-ball to eye-ball with media present, especially since I sued him and will again shortly. Canadian Coalition for Health Freedom [CCHF] Update          Thursday evening June 12th 2008   A Message from Trueman Tuck,   I was in Ottawa on Monday June 9th and Tuesday June 10th 2008 Lobbying and educating Members of Parliament and their staff on why we need Bills C-51 and C-52 and the Drug Sub-class Natural Health Product Regulations rescinded immediately.   Thank you all for the excellent efforts of everyone involved in this historic Health Freedom Campaign. Senior officials in Ottawa told me that they had never seen a grassroots’ uprising of such a scale involving the entire country before.   As a Health Freedom Movement all of us need to thank the NDP for having stopped the Conservative schemes to fast track Bill C-51 though second reading. It is the NDP House Leader’s refusal to agree to consent to second reading without a formal debate and vote that opened up this week’s excellent discussion.   The Conservative Leadership was at the beginning of the week still trying to control which Conservative would speak to Bill C-51 and what they would say.   Now it appears that the Liberals are now starting to question this hasty and poorly designed Bill C-51 – see letter below and need to be encouraged to not allow rushed, ill-conceived and flawed Bill C-51 to pass second reading – see links below.   The Conservative Leadership is still determined to force Bill C-51 though as soon as possible.
